Everguide & Co is not a law firm, and no one at Everguide & Co is acting as your attorney. Nothing on this website, and nothing we say to you in conversation, constitutes legal advice or a legal opinion. No attorney–client relationship is created by using this site, contacting us, or engaging our services.

1. What we provide

Everguide & Co provides non-legal administrative and personal assistance services relating to the settlement of a decedent's affairs. This includes obtaining and organizing documents, completing and submitting forms at the client's direction, communicating with financial institutions and government agencies on a client's behalf where permitted, tracking the status of pending items, and — where separately agreed in writing — serving as personal representative or in another fiduciary capacity.

2. What we do not provide

We do not provide, and nothing on this site should be understood to offer:

  • Legal advice, legal opinions, or legal representation
  • Advice about your legal rights, obligations, or remedies
  • Interpretation of wills, trusts, contracts, or other legal instruments
  • Selection of which legal procedure or strategy you should pursue
  • Representation before any court or tribunal
  • Tax advice, tax planning, or tax return preparation
  • Investment, insurance, or financial advice

Where your situation calls for any of the above, you should engage a licensed attorney, certified public accountant, or other appropriately licensed professional. We will tell you when we believe that is the case, but the responsibility to obtain professional advice remains yours.

3. Information on this site is general

The guides, checklists, and explanatory material on this website describe general procedures in Colorado. They are provided for informational purposes only. Laws, dollar thresholds, forms, and agency requirements change, and general information may not apply to your particular circumstances.

We make no warranty that information on this site is current, complete, or applicable to your situation. Verify anything you intend to rely on with the relevant agency, court, or a licensed professional. Do not delay seeking professional advice, or disregard advice you have received, because of something you read here.

4. No professional relationship from use of this site

Using this website, reading its materials, submitting the contact form, or sending us an email does not create any professional, fiduciary, agency, or confidential relationship between you and Everguide & Co. A relationship arises only when we have both signed a written engagement agreement describing the specific services to be provided.

Please do not send confidential or sensitive information — Social Security numbers, account numbers, or the like — through the contact form or by unencrypted email before an engagement is in place.

5. Client responsibilities

Where we do enter an engagement, you remain responsible for:

  • The accuracy and completeness of the information and documents you provide to us
  • All decisions about the estate, including which procedures to use and how assets are distributed
  • Reviewing any document before it is signed or submitted on your behalf
  • Obtaining legal or tax advice where your situation requires it

We act at your direction. We do not make substantive decisions about an estate on your behalf, except where we have been formally appointed as personal representative under a separate written agreement, in which case the duties of that role govern.

6. Fiduciary engagements

Any engagement in which Everguide & Co serves as personal representative, agent, or in another fiduciary capacity is governed by a separate written agreement and by applicable Colorado law, not by these terms of use. Compensation for such service is agreed in writing in advance and is subject to the reasonableness standards applicable under Colorado law.

7. Fees and engagement

Initial consultations are provided at no charge and create no obligation. Fees for services are quoted in writing before work begins and are set out in the engagement agreement. Fees do not include third-party costs — court filing fees, certified copy fees, recording fees, postage, and similar disbursements — which are your responsibility and are passed through without markup unless we agree otherwise in writing.

8. Limitation of liability

To the fullest extent permitted by Colorado law, Everguide & Co and its members shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of this website or its content. Our aggregate liability arising from any engagement shall not exceed the fees actually paid to us for that engagement, except where such limitation is prohibited by law — including with respect to fiduciary duties owed in an appointed capacity, which are governed by law and not limited here.

This website is provided "as is," without warranties of any kind, express or implied.

9. Third-party links

This site links to third-party resources, including Colorado government websites. We do not control those sites and are not responsible for their content, accuracy, or availability. A link is not an endorsement.

10. Intellectual property

The content of this website is owned by Everguide & Co. You are welcome to print or share our checklists and guides for personal, non-commercial use — that is what they are for. Republishing them commercially, or presenting them as your own, is not permitted.

We may update these terms from time to time. The date at the top reflects the most recent revision. Continued use of the site after a change constitutes acceptance of the revised terms.

12. Governing law

These terms are governed by the laws of the State of Colorado, without regard to its conflict of laws provisions. Any dispute arising under them shall be brought in the state or federal courts located in Colorado.
